Peter J. PhillipsPartner Peter J. Phillips has more than 30 years of experience and is well-versed in virtually all intellectual property areas with particular expertise in patent and trademark litigation, patent and trademark application preparation and prosecution, counseling on patent and trademark validity and infringement matters, and licensing. His litigation experience includes representing patent and trademark owners and accused infringers in litigation in the federal and state courts on matters involving claims of infringement of utility patents, design patents, trademarks, copyrights, and unfair competition. He has represented clients before the International Trade Commission involving claims of utility patents and trade dress infringement. He has also represented a client successfully in a matter before the U.S. Supreme Court. As a result of his litigation experience, Mr. Phillips has a Martindale rating of AV+, the highest rating available. He counsels clients in various industries on enforcement of patents and trademarks. He also advises clients on avoiding liability on others’ patents by investigating and developing invalidity and non-infringement positions. Mr. Phillips has substantial experience in preparing and prosecuting numerous patent applications in the electrical and mechanical arts, with particular emphasis on medical diagnostic and treatment, devices, systems, methods, processing techniques, and imaging. In his patent practice he also has experience with wireless communication devices and systems, semiconductor circuits, and GPS vehicle tracking. In complex proceedings before the U.S. Patent and Trademark Office, Mr. Phillips has handled numerous patent reexaminations, reissues, and interferences, and trademark cancellation and opposition proceedings. Formerly a partner at Cooper & Dunham in New York, he was a featured speaker at the Fourteenth Annual Joint Seminar Program of the New York and New Jersey, Connecticut and Philadelphia Intellectual Property Associations. His manuscript and presentation were titled, “Markman Hearing – Timing, Discovery, and Evidence”
